School District of Reedsburg
Copyright Policy
A. The School District of Reedsburg shall provide all staff with inservice training and information relating to the copyright law.
B. The School District of Reedsburg expects all employees and users of district-owned materials to be knowledgeable of the provisions and to abide by the 1976 federal copyright law (Public Law 94-553, Title 17 and Public Law 96-517 Section 7(b) which amends Section 117 of Title 17) and the guidelines that have been drawn up to help educators interpret the law. Copies of these laws are on file in all district IMC's.
C. The copying or broadcast of copyrighted materials including, but not limited to, computer software, videos and print materials owned by the School District of Reedsburg is prohibited without the prior written permission of both publisher and the school district.
D. All copying not specifically allowed by the current copyright law, fair-use guidelines, license agreements, or proprietor's permission is prohibited.
E. All pre-recorded videocassettes and computer software brought into a classroom will be for instructional purposes and follow the selection polices of the district.
F. Appropriate notices and warning signs will be placed on all copying equipment such as VCR's audio cassette recorders, computers, photocopiers, microfiche copiers, opaque projectors, and overhead projectors.
G. Assistance will be provided by IMC staff to school personnel acquiring the rights to duplicate copyrighted materials. Permission request form, phone numbers and addresses will be provided upon request.
H. Copyright law does not authorize schools to publicly perform "For Home Use Only" videotapes before a group of persons.
I. Reading or performing of copyrighted materials on cable television without permission of the copyright owner is prohibited.
J. Videotaping programs from exclusively cable or satellite channels for use in the classroom is prohibited without the prior written permission of the copyright holder.
K. Programs taped from broadcast channels (broadcast channels are those UHF or VHF channels one can ordinarily receive via a regular television antenna) must be used under the following criteria: - 1. Videotaped recordings may be kept for no more than 45 calendar days after the recording date, at which times the tapes must be erased.
- 2. Videotaped recordings may be shown to students only within the first 10 school days of the45-day retention period.
- 3. Off-air recordings must be made only at the request of an individual teacher for instructional purposes, not by school staff in anticipation of later requests by teachers.
- 4. The recordings are to be shown to students no more than two times during the 10- day period, and the second time only for necessary instructional reinforcement.
- 5. The taped recordings may be viewed after the 10-day period only by teachers for evaluation purposes; that is, to determine whether to include the broadcast program in the curriculum in the future.
- 6. If several teachers request videotaping of the same program, duplicate copies are permitted to supply their request; all copies are subject to the same restrictions as the original recording.
- 7. The off-air recordings may not be physically or electronically altered or combined with others to form anthologies, but need not necessarily be used or shown in their entirety.
- 8. All copies of off-air recordings must include the copyright notice on the broadcast program as recorded.
L. The district's administrators and supervisors will not direct any staff member to willfully or knowingly violate the copyright law.
M. The use of school equipment for the purpose of violating copyright law is prohibited.
N. The liability for infringement of copyright law is placed on the district employee or user of district materials who requests or makes the copy. The School District of Reedsburg assumes no responsibility and will provide no legal assistance.
